The law had gone back and forth until 2007 when the US Supreme Court ruled in Leegin v. PSKS. What the court said is that under the Sherman Act price fixing of this sort is not per se illegal (not illegal just because you do it), but there are circumstances when it can be illegal (such as if you hold a near monopoly on the market).
