The purpose of the Emotiva Forums Emporium is to provide a place where Forum members can arrange to buy, sell, and trade used audio equipment. While we want everyone to have fun here, and we encourage Forum members to participate in the Emporium, we do have some rules and guidelines everyone must follow. By participating in the Emporium you are agreeing to the following rules, terms, and conditions.
1. Any transactions that are conducted on the Emporium, or that are arranged or facilitated here, are PRIVATE TRANSACTIONS BETWEEN INDIVIDUALS. Even though Emotiva staff may sometimes review Emporium postings, and may remove postings that we deem inappropriate, Emotiva will not be a participant in any transaction arranged on the forum, and should not be assumed to have either approved or authorized any specific transaction. We do NOT provide any type of buyer or seller protection.
2. If you’re considering purchasing any Emotiva equipment on the Emporium, we STRONGLY suggest that you verify the warranty status of the seller and the equipment in question. If you post Emotiva equipment for sale on the Emporium, we shall assume that posting constitutes your release for us to share the ownership and warranty status of that equipment with potential purchasers. (Please see Note 1 below.)
The sale or barter of stolen or illegal merchandise on the Emporium is strictly forbidden. This includes trading music files (which are generally not licensed in such a way that ownership can be legally transferred). (Please see Note 2 below.)
3. Because the Emporium is expressly intended to help INDIVIDUALS buy, sell, and trade equipment, storefronts selling commercial products are forbidden, as is anything that we deem to be commercial promotion or advertising.
4. The “snake oil rider”. Because we do not officially verify or endorse products sold on the Emporium, you might see something for sale that you believe is some form of “snake oil”. If so, feel free to ask another Forum member or member of Staff what they think about it (and they may or may not respond). However, as long as it’s something that can be bought in a legitimate audio store, we probably aren’t going to prevent the seller from selling it to anyone who wishes to purchase it.
5. For the sake of common courtesy the following should be observed:
- Items are required to be listed with prices or an idea of what a person would like to trade for...no bidding
on items. This is a section for enthusiasts, not serial/for profit buying selling.
- Do not derail the OP's thread with distracted posts
- The OP should limit bumps to once daily
- After the unit is sold, the OP should modify the thread title with the word "SOLD" in it.
Note 1: Warranty Transfers - It has always been our official policy that any warranty transfer must be initiated by the warranty holder. This means that, if you purchase a piece of used Emotiva equipment which is still under warranty, and whose warranty is eligible for transfer, the seller and current holder of the warranty must contact us and tell us to transfer the warranty to you. This policy will be strictly adhered to in the future. We will be glad to verify the warranty status of any Emotiva equipment before you purchase it, but it is up to you to arrange for the seller to contact us and transfer their warranty to you after the purchase.
Note 2: Music and Video Copyrights - The current copyright law on music is widely agreed to include your right to make a backup copy of music you own, and this is usually interpreted to include placing an electronic copy of music you own on a server or hard drive for purposes of security or convenience – as long as you retain ownership of the original media. Note that, by this definition, the same person must retain ownership of both the original media and the digital copy. You may NOT legally rip your CD collection, then give the discs to someone else, or sell them, unless you destroy the ripped copies on your server; and you may NOT legally sell your server to someone, and allow the digital copies to remain with it, unless you include the original discs with it in the sale. The same requirements hold true for audio CDs, video DVDs and Blu-Ray discs, and presumably even vinyl albums. It is also true for music downloads from sources like HDTracks and other online stores… unless they specifically say otherwise. And, in case anyone was still wondering, giving or selling copies of music that you’ve purchased or downloaded is illegal in general – unless the copyright holder has EXPRESSLY given permission to do so (some few bands may encourage you to give away copies of their music – but they’ll say so very clearly). If you have any doubts – ask a lawyer.
